Synopsis:
Bobby's classmate from law school (Caitlin O'Malley) shows up needing help with a case. Her client stands accused of involuntary manslaughter in the death of her homeborn infant son. It becomes apparent to the rest of the firm that Caitlin wants more from Bobby than just help with a case.
{The office is bustling, phones ringing, Rebecca, Ellenor and Jimmy working at their desks. Enter Jamie, looking frazzled.}
LUCY: {hands Jamie message slips} Jamie, you need to call Joel Brady back, he's been calling all morning.
JAMIE: {puzzled} Who?
LUCY: Your drug case. Court appointed. Eugene talked to you about it yesterday, remember?
JAMIE: {still clearly distracted} Oh, right. {Jamie heads to her desk.}
LUCY: Ellenore? You're due in court in ten.
ELLENORE: Well if Jimmy would get it together we could go.
JIMMY: I'm together. Why is it always 'Jimmy get it together'?
ELLENOR: Why are you always late?
{bickering ensues, as the door opens, enter Caitlin O'Malley}
LUCY: Who're you?
ALL: Lucy!
LUCY: {indignant} What? You're all allowed to be pissy but I'm not?
ELLENORE: Can I help you?
CAITLIN: I'm looking for Bobby Donnell, is he in?
LUCY: Do you have an appointment?
CAITLIN: No, we're old friends. I was hoping he could help me with a case. I'm sorry. {extends hand} I'm Caitlin O'Malley, I'm an attorney.
ELLENORE: {looks pointedly at Lucy} Jimmy, we're late.
{exit Jimmy and Ellenor}
LUCY: I'll let Bobby know you're here.
{Bobby emerges from office, looking at papers in his hand}
BOBBY: Jamie, I need to do some research for me on search and seizure, I need... {Bobby sees Caitlin and stops } Cait?
CAITLIN: Bobby! I wasn't sure you'd remember me!
LUCY: I thought you said you were old friends.
BOBBY: Lucy! {walks over to Caitlin, they embrace} What are you doing here? I thought you went to Los Angeles?
CAITLIN: Well, I did, but I'm a sucker for the Boston winters. {smiles} The short version is that I quit my job, hung out a shingle of my own and I could use your advice.
LUCY: Bobby you've got a meeting with the Angelinos at 10:00.
BOBBY: Eugene can handle that. {to Caitlin} You look great.
CAITLIN: {Blushing} Yeah, it's amazing what you can do with a treadmill these days.
BOBBY: {to Lucy} Hold my calls, Lucy.
LUCY: {muttering} Hold your calls. You hold the calls.
Bobby's office, door shuts. Bobby takes Caitlin's coat, motions for her to sit on the couch. Bobby sits on the edge of the desk
BOBBY: What's up?
CAITLIN: Well it's pretty much the same story as always. I need some help. You know, just like exam time in law school. {smiles} Bobby, I got myself in deep in this one, and I need a real powerhouse to help me out. Someone who knows the ropes here in Boston.
BOBBY: What's the case?
CAITLIN: Commonwealth vs. Shaw.
BOBBY: {incredulous} The Baby Killer Case? How'd you land that?
CAITLIN: The mother, Laura Shaw is a friend of mine from grade school. She called me, asked me to take the case. Begged me, actually. It's the reason I'm back in Boston actually. Bobby this is a witch hunt.
BOBBY: These are the parents were attempting to have a baby at home, without any one else in attendance?
CAITLIN: Yes, and now the state is saying the mother was criminally negligent because she didn't call the paramedics when her son was stillborn. Bobby, this is my friend. She has three other children at home. I cannot let her go to jail.
BOBBY: I'm sure Eugene and I can help you out.
CAITLIN: {visibly relieved} I can't tell you how much that means to me. I have a meeting set up for this afternoon. {smiling} I could always count on you. It's nice to be among friends again.
BOBBY: You quit your job and came back to Boston for one case?
CAITLIN: {looks downward} Not exactly. My marriage was over.
BOBBY: Oh Cait, I'm so sorry.
CAITLIN: Well, it was probably over before it started. Who gets married at 22 anyway? {nervous laughter} Actually I needed the change and I read about. .. the trouble with Lindsay and thought, Why not come home? I've missed the city, my parents.... you.
BOBBY: Cait...
CAITLIN: I know, you're married. {sad smile} Your little boy is beautiful. And Lindsay is a lucky woman to have someone who'd stand by her through such an ordeal. {Stands} Anyway, I'll meet you there at 2:00? turns toward the door
BOBBY: nods I'll be there. {catches Caitlin's arm} Cait, I didn't mean ... I'm really glad you're home.
CAITLIN: Me, too. I'll see you later. {Caitlin exits Bobby's office and leaves, Bobby follows her out to the main office area.}
LUCY: {eyebrows raised} What was that all about?
BOBBY: None of your business. Lucy, tell Eugene I need to see him in my office as soon as he gets in. {exit Bobby}
LUCY: {muttering} It may not be my business, but I'm pretty sure Lindsay'd want to know.
Bobby and Caitlin have met with Laura Shaw in prison, and are making an appearance before Judge Hiller. Also present is Helen Gamble, DA.
HELEN: Your honor, the defense is arguing that the state had no compelling interest to intervene into this case. The Commonwealth certainly has an interest in the welfare of it's children.
BOBBY: When it's convenient. Your honor, this is clearly a case where the state has overstepped it's bounds. Laura Shaw is a grieving mother, who had a stillborn son not two weeks ago...
HELEN: {interjecting} Born alive according to the ME.
BOBBY: Oh that is crap!
{Helen and Bobby bicker, Judge Hiller pounds her gavel and calls for order}
CAITLIN: {standing} Your honor, if I may, there's nothing in the statutes preventing Mrs. Shaw from having an unattended homebirth and what the DA is trying to do is -
JUDGE HILLER: {interrupts} Who are you?
CAITLIN: Caitlin O'Malley, Mrs. Shaw's attorney.
HELEN: {rolling her eyes} Great, Bobby, another new shark for your fish tank?
BOBBY: {yelling} HEY!
{bickering continues, Judge Hiller slams on her gavel}
HELEN: Your honor, any reasonable person would know that attempting to birth a child at home, without medical assistance is dangerous at best. Here, the worst has happened. A child is dead.
CAITLIN: There was no way for Mrs. Shaw to know her son would be still born.
HELEN: The medical examiner will testify that baby Shaw was in fact born alive and died of repertory distress due to the negligence of the defendant.
CAITLIN: {clearly angry} There is no proof her son was born alive and to suggest -
HELEN: {interrupting, and sarcastic} May I suggest you read up on Massachusetts law?
CAITLIN: {yelling} May I suggest you get your bony ass to a diner and have a cheeseburger?
JUDGE HILLER: {gavel pounding} Alright! That's enough! Mr. Donnell, am I to assume that you and Ms. O'Malley have an expert willing to testify that the child was in fact still born?
BOBBY: We do.
JUDGE HILLER: Probable cause hearing, tomorrow, 9:00 am. {gavel} Dismissed!
HELEN: {to Caitlin} Cheeseburger, that's cute.
CAITLIN: I don't do cute, Ms. Gamble. I do all out bitchy. {smiles}
CAITLIN: You're sure your doctor can prove that baby was stillborn?
BOBBY: Yes, Cait, I'm sure. I told you, I talked to him this afternoon. He had looked over the file and said he'd be able to poke holes in the state's report.
CAITLIN: {distressed} Poke holes? We need him to do a hell of a lot more than poke holes in their evidence. We need a rocket launcher! {throws down book in her hand} I cannot let Laura go to jail, not for this Bobby. {rubs eyes}
BOBBY: Look, I know how hard it is to defend someone you care about but you have to emotionally distance yourself from it or you'll go crazy. {sits next to Caitlin} You have to have some perspective.
CAITLIN: Are these little insights your lessons learned from Lindsay's trial?
BOBBY: Partly. We made some mistakes with that case and I won't let you make the same ones.
CAITLIN: {half smiles} That's the Bobby Donnell I know and love. Always to my rescue. {wipes eyes} You know I had such a crush on you in law school.
BOBBY: {hesitant} Caitlin, don't...
CAITLIN: {shakes head} No, Bobby, I need to tell you this. I've needed to tell you this ever since you graduated. I've thought about you so often since then. When things got bad, and then worse, with Matthew, when I was cataloging the regrets of my life, you were always at the top of the list. I never told you how I felt about you and that remains the biggest mistake of my life. I won't make that mistake twice. {deep breath} I was so in love with you. {Bobby bows his head} No, Bobby, please don't make this harder than it has to be for me. I have to get this out. I was in love with you from the first time I met you. You were older than I was, and when you're 21 a few years make all the difference in the world. I loved being around you, loved that you held my hand when that guy broke my heart freshman year, loved that you helped me through Con Law with old Professor McGovern. Loved everything about you, but I was too shy to tell you. And when you left law school, and started dating that girl from the clerk's office, well, I knew I had lost a chance at something wonderful. {tears form in Caitlin's eyes} And I moved away and got married to the first guy I could, and tried to make a life away from you but I never, ever forgot you. When I heard about the trial with Lindsay, I couldn't stop thinking about you. And my marriage was ending, and things were in such chaos ... {pause} And then Laura called me and it seemed like such a sign. I need to tell you that a part of me is still very much in love with you, and I don't know how to make it stop.
BOBBY: Caitlin. I didn't know you felt that way, I just thought...
CAITLIN: Thought what? That I was just a nice girl with a crush? You knew. I know you knew. You loved the attention. You always loved the attention, that's part of what makes you such a great lawyer. You love the spotlight, and you loved that I was your biggest fan.
BOBBY: That may have been true but things have changed a lot since law school. I'm married, I have a son.
CAITLIN: I know things have changed. I've changed, Bobby, I'm not that shy young girl you used to know. And I'd never dream of asking the honorable Bobby Donnell to betray his commitment. Which is why I need to be the one to do this. {Caitlin leans in, and kisses Bobby gently on the lips. Bobby's hands cup her face as they kiss for a long moment.} See, that wasn't so hard, was it? fade out
EUGENE: Bobby this is simple stuff, why are you so jumpy all of the sudden?
BOBBY: {Sitting.} It's not this case, it's ... It's Caitlin.
EUGENE: {looks at Bobby} What do you mean 'It's Caitlin'. I hope you don't mean what I think you mean.
BOBBY: {sighing} She kissed me last night. Well, we kissed.
EUGENE: Bobby, what the hell is wrong with you?
BOBBY: I don't need a lecture Eugene, I know it was stupid. I've known this girl since law school. I mean, I knew she had a crush on me, we had a lot of flirting but I never thought ... she kissed me.
EUGENE: So the great Bobby Donnell was taken off guard? {smirks} That's it, isn't it? You had the tables turned on you, didn't you? You were the big man on campus and now she's the one in charge and that gets to you, doesn't it?
BOBBY: Maybe. But Eugene, this kiss. It was no peck on the cheek.
EUGENE: Well I figured that, just from the look on your face. You want my advice? You tell her in no uncertain terms that you are a married man, or have you forgotten that?
{knock on the door}
LUCY: Your girlfriend is here.
BOBBY & EUGENE: LUCY!
LUCY: {indignant} Sorr-ee. {affects British accent} Ms. O'Malley is here to see you, sir.
enter Caitlin
EUGENE: I think you've got a strong case, Bobby. Just remember what I said about how to close this thing. {raises eyebrow and exits}
BOBBY: {picks up jacket, briefcase} We'd better go, we'll be late.
CAITLIN: Bobby, I think we need to talk.
BOBBY: Caitlin, look, I need to tell you that -
LUCY: {opens door} You're late.
Bobby and Caitlin exit together
BOBBY: You were great in there, you know that?
CAITLIN: {Smiling} Yeah? Well, I had a good mentor. {puts her hand on Bobby's hand}
BOBBY: Cait, we've got to talk.
CAITLIN: {smile fades a bit} I know.
BOBBY: You know I -
CAITLIN: {holds up her hand to silence Bobby} Please, let me be the one to say it.
BOBBY: {small smile} Am I ever going to get to talk or are you going to say it all?
CAITLIN: {chuckles} You did plenty of talking in law school, and I sat and absorbed it all like a loyal subject should. It's my turn.
BOBBY: {hesitant} Okay.
CAITLIN: Bobby, I put you in a terrible position yesterday. Maybe it was just being here, in Boston after all these years, seeing familiar places and people and then seeing you ... it was more of a shock than I thought it would be. I'm sorry, I should never have laid all that baggage on you and I certainly never should have kissed you. {pause} No, actually I'm not sorry I kissed you. {looks down} I've been waiting for years to kiss you. You were like my holy grail and I held onto that idea for years. If I could have just kissed Bobby Donnell in law school, I never would have made all the million mistakes I've made in my life since then. And I was lying in my hotel room last night and thinking, 'I've done it, I've kissed him and all my problems are still here. The earth didn't spin on a different axis after I kissed Bobby Donnell.' {looks up at Bobby, eyes tearing} You used to epitomize all the regrets I had about my life: marrying Matthew, moving to a new city, taking a job I was less than thrilled with. I thought it all traced back to you. But it all traced back to me. And I can see that now. {laughs} Not bad for a girl with a Harvard education, eh?
BOBBY: Caitlin, you know you'll always mean something to me. And I am glad you're back home.
CAITLIN: Me, too, Bobby, but I think it's just safer for all of us if I stick to my own side of the street.
BOBBY: I don't want you to feel like you can never call me.
CAITLIN: I can call Donnell, Young, Dole and Frutt but I can't call my friend Bobby. At least not until I get my head together. {stands up}
BOBBY: You don't have to leave.
CAITLIN: Yes, I do. {smiles} Otherwise I just might be tempted to kiss you again. {leans in to Bobby's ear} And I don't think you could handle that.
BOBBY: {laughing} You might be right about that. Promise to stay in touch.
CAITLIN: I will. {pause} Lindsay is a lucky woman, does she know that?
BOBBY: I'm the lucky one.
CAITLIN: {wistful smile} Thanks for bailing me out one last time, Bobby. I'll see you around. {walks away}
{camera holds on Bobby, watching Caitlin walk away and nursing his drink to fade out}
